Notwithstanding anything to the contrary contained herein, in particular Sections 7.5, 7.12 and 7.13, if a breach of a covenant occurs, the Purchaser shall be entitled to all rights and remedies that it or the Reval Group may have under law or in equity, including the right to have an injunction issued by any competent court.
If the Purchaser or Reval Group must resort to arbitration or litigation to enforce any of the Covenants that has a fixed term, then such term shall be extended for a period of time equal to the period during which a breach of such Covenant was occurring, beginning on the date of a final arbitral award or court order (without further right of appeal) holding that such a breach occurred or, if later, the last day of the original fixed term of such Covenant.
Each Stockholder severally expressly acknowledges that it would be extremely difficult to measure the damages that might result from any breach of any of the Covenants, and that any breach of any of the Covenants may result in irreparable injury to the Reval Group for which money damages could not adequately compensate.
