Retail Software definition

Retail Software shall be defined to mean any software sold as a standalone product not preinstalled or preloaded on a Product. Terms and conditions for sale of third party Retail Software are set forth in Section 13 below.
Retail Software means Software used by Company in connection with its business that is generally available to any Person under a fixed use license agreement, including computer software that is commercially available in the retail market, downloadable or otherwise available under non-negotiable terms and conditions generally provided with a software product not considered open source.

Examples of Retail Software in a sentence

  • The Contractor agrees that IP Deliverable created as part of the Deliverables, Software, Retail Software and Operating Systems, to which the Customer obtained a License and/or Sub-license pursuant to this Agreement, may be provided by the Customer for use to Controlled Entities, such use to include any manner of use anticipated as of the execution date hereof by the Copyright Act.

  • Any rights of return and/or refund under these Terms and any applicable returns policy DO NOT APPLY to Retail Software (if available).

  • The fee for the use of the Software, Retail Software and Operating System by the Customer and Controlled Entities is included in the Price.

  • The fee for the License or Sub-license or Retail Software License is included in the Price.
