If Licensee’s Application is not successfully launched in any Store, and the reason for such lack of success is due to (i) Licensee’s or the Application’s failure to comply with any Store’s checklist, guidelines or other requirements or (ii) not otherwise due to the fault of Hatch Apps, then any Submission after the initial Submission shall be deemed to be a Resubmission.
