Restoration; Maintenance a. Upon completion of initial construction of the multi-purpose path, street lighting, and traffic signals, Village shall perform all surface restoration, including installation of a minimum of four inches of topsoil and matching existing adjacent lawn grades. All disturbed areas on the Property shall be filled, compacted, seeded and mulched such as to restore disturbed areas by Village to substantially the condition as existed prior to Village’s activities thereon. b. Maintenance and repair of street lighting shall be the obligation of the Village and traffic signal shall be the obligation of the Ozaukee County. Village reserves the right to engage agents, subcontractors, employees or other third-parties to perform the maintenance obligations imposed on the Village hereunder, at Village expense. c. Maintenance, repair, and snow and ice removal of and on the multi- purpose path shall be the obligation of the Grantor. The multi-purpose path shall be treated as a sidewalk for maintenance and repair purposes and shall be subject to the terms and conditions of the sidewalk statute, section 66.0907 Wis. Stats., and any local ordinance, rule or regulation adopted under or pursuant thereto.
Restoration; Maintenance. City shall take reasonable steps necessary to protect the Subject Property from any unnecessary damage occurring from the Work. Upon completion of the Project, City shall, without further notice, vacate the Subject Property, remove any fencing, equipment or personal property of City therefrom, and repair, or cause to be repaired, any damage to the Subject Property caused by the Work, including but not limited to damage to irrigation lines and landscaping, and restore all affected portions of the Subject Property to substantially the same condition thereof which has existed prior to the Term with the exception of any improvements constructed or installed within the Subject Property as determined by a survey conducted upon completion of the Project (“Improvements”) which Improvements the City shall maintain and repair in good working order for the life of the Improvements. Notwithstanding the foregoing, City shall promptly repair or cause to be repaired any unnecessary damage caused by the Work prior to completion of the Work if such damage would likely result in health or safety issues if not repaired.
