Response Work definition

Response Work means all activities Settling Defendants are required to perform under this Consent Decree, except those required by Section XVI (Natural Resource Restoration Efforts) and Section XXVII (Retention of Records).
Response Work means implementation of a Removal or Remedy inat Operable Units 2 and 4 (or, in accordance with Section 3.05 of this Agreement, Operable Unit 3) of the Diamond Alkali Site pursuant to the requirements of an administrative order issued by or entered into with EPA or a consent decree entered into with EPA including, without limitation, the performance of remedial investigations, feasibility studies, remedial designs, remedial actions, engineering evaluations, cost analyses, and removal actions as those terms are defined in CERCLA and the National Contingency Plan; provided, however, that Response Work does not include any Excluded Costs.
Response Work means the following work at Operable Units 2 and 4 of the Diamond Alkali Site: a) services related to the performance of Remedial Investigations, Feasibility Studies, Engineering Evaluations, Cost Analyses, Remedial Design, Removal Actions, Natural Resource Damage Assessment, and Restoration, as those terms are defined in the NCP, CERCLA, OPA or their state government equivalents; b) services for the performance of Facility Investigations and Corrective Measures Studies as those terms are defined under RCRA; and c) work performed at Operable Units 2 and 4 of the Diamond Alkali Site pursuant to requirements of eligible administrative orders or consent decrees and consistent with the National Contingency Plan and Environmental Law; provided, however, that Response Work does not include any Excluded Costs.

Examples of Response Work in a sentence

  • The City shall pay for the Contractor’s satisfactory Emergency Response Work in accordance with Exhibit B.

  • If Work on a Task Order for Emergency Response Work commences prior to the Agreement’s expiration (including, on the last Day of this Agreement), the Contractor shall continue Work on the Task Order (including any Supplementary Task Orders relating thereto) for Emergency Response Work and all the terms of this Agreement shall apply.

  • When the conditions in Article 5(A) have been met, the Agency may award a Task Order for Emergency Response Work to one or more contractors awarded a contract, including Contractor.

  • This Article 5 (the “Payment Guarantee Provision”) does not apply to any Task Order for Emergency Response Work that does not involve Work for the prosecution of a “public improvement” as that term is used in section 137 of the N.Y. State Finance Law (a “Public Improvement”).

  • The Commissioner, after declaring the Contractor in default on a Task Order for Emergency Response Work, may then have the Work completed by such means and in such manner, by contract with or without public letting, or otherwise, as he or she may deem advisable in accordance with the applicable PPB Rules.

  • If the completion time under a Task Order for Emergency Response Work is not known at the time the written Task Order for Emergency Response Work is issued, the Parties will work together to determine a mutually acceptable date for final completion or, if applicable, Substantial Completion and shall issue a Supplemental Task Order that contains the agreed upon date.

  • Payment for Task Orders for Emergency Response Work will be paid on a unit rate basis, in accordance with Attachment 1.

  • Following a Task Order for Emergency Response Work, the Contractor must list its Subcontractors in the web based Subcontractor Reporting System through the City’s Payee Information Portal (PIP), available at xxx.xxx.xxx/xxx.

Response Work means the work related to identifying and investigating contamination or other environmental conditions at a Site, evaluating remedial options, and designing, and providing detailed engineering services precedent to the implementation of remedial measures in response to environmental conditions at a Site or preparing and providing risk assessments and/or endangerment
Response Work means the performance of services related to identifying and investigating contamination or other environmental conditions at a Site, evaluating remedial options, and designing, and providing detailed engineering services precedent to the implementation of remedial measures in response to environmental conditions at a Site or preparing and providing risk assessments and/or endangerment assessments of the Site. Response Work includes services related to the performance of Remedial Investigations, Feasibility Studies, Engineering Evaluations, Cost Analyses, Remedial Design, as those terms are defined in the NCP. It also includes services related to the performance of RCRA Facility Investigations, and Corrective Measures Studies as those terms are described under the hazardous waste management program of the U.S. Environmental Protection Agency (U.S.E.P.A.). However, for purposes of this Agreement, Response Work does not include construction-type activities such as are associated with the terms “Removal” or “Remedial Action” as defined in the NCP or “Corrective Action” as defined by U.S.E.P.A.’s hazardous waste regulations.

Related to Response Work

  • piece-work means any work the pay for which is estimated by the amount of work performed irrespective of the time occupied in its performance;

  • Urgent Work means any urgent measures which in the opinion of Engineer-in-charge become necessary during the progress of the work to obviate any risk of accident or failure or disruption of generation which become necessary for security.

  • Project Architect means the architect retained by Lessee to design and supervise construction of the Improvements.

  • Defective Work means (a) Work that is unsatisfactory, deficient or damaged, does not conform to the Contract Documents, or does not meet the requirements of any inspection, test or approval, or (b) Work associated with punch list items that the Contractor fails to complete within a reasonable time after issuance of the punch list by the Project Manager.

  • Acceptance Tests means those tests performed during the Performance Period which are intended to determine compliance of Equipment and Software with the specifications and all other Attachments incorporated herein by reference and to determine the reliability of the Equipment.

  • Completion Notice means a notice issued by the Developer in accordance with clause 6.1.

  • Tenant Improvement Work means the construction of the Tenant Improvements, together with any related work (including demolition) that is necessary to construct the Tenant Improvements.

  • Work Request means a document prepared by the Contractor which describes over and above work being proposed.

  • Contract Work means everything required to be furnished and done by the Contractor by any one or more of the parts of the Contract referred to in Article 1, except Extra Work as hereinafter defined.

  • Interconnection Feasibility Study means either a Generation Interconnection Feasibility Study or Transmission Interconnection Feasibility Study.

  • Standard Specifications means a compilation in book form of specifica- tions approved for general application and repetitive use;

  • Substantial Completion means the stage in the progress of the work as determined and certified by the Contracting Officer in writing to the Contractor, on which the work (or a portion designated by the Government) is sufficiently complete and satisfactory. Substantial completion means that the property may be occupied or used for the purpose for which it is intended, and only minor items such as touch-up, adjustments, and minor replacements or installations remain to be completed or corrected which:

  • improvement notice means the notice issued by the Authority to the Supplier pursuant to Clause 32.1.3 (Authority Remedies) which will detail how the Supplier shall improve the provision of the Goods and/or Services;

  • Project Completion means completion of the Redevelopment in accordance with this Agreement to the state where the whole of the Morley Shopping Centre, as so redeveloped, is capable of occupation for its intended purpose;

  • Additional Work to mean additions or deletions or modifications to the amount, type or value of the Work and Services as required in this Contract, as directed and/or approved by the County.
