REPORT CERTIFICATION definition
REPORT CERTIFICATION means a certification to be delivered by the Operating Advisor (provided that one has been elected pursuant to Section 9.37 of this Agreement) or any Certificateholder or Certificate Owner in connection with such Person's request for any report or notice pursuant to Section 9.39(b), substantially in the form of Exhibit K hereto, establishing the status of such person as a Certificateholder or Certificate Owner and certifying that such person will agree to keep the information contained in such notice or report confidential and will not use such information to buy or sell securities in violation of the Securities Act of 1933, as amended.
