Repeated Failure definition

Repeated Failure means the occurrence of the events set out in Paragraph 4 of Part 4 of Section A this Schedule Part 7;
Repeated Failure the deduction of Performance Points in relation to a Performance Failure where the Contractor has already been deducted Performance Points in relation to the same KPI and Performance Failure in the Repeated Failure Period; "Repeated Failure Multiplier" the multiplier to be applied to any further Performance Points incurred by the Contractor (where the Contractor fails to rectify a Performance Failure within the relevant Rectification Period) as set out in column 2 of table 2 of Schedule 14 (Performance Mechanism);
Repeated Failure shall occur whenever for the same obligation under the Contract inadequate performance is found three or more times, regardless of the time between different failures.

  • If the Repeated Failure cannot be cured within the five (5) day period, Manitoba shall request an executive review involving a senior representative from each party.
