Repeat violent offender definition
Repeat violent offender means a person about whom both of the following apply:
Repeat violent offender means a defendant who is convicted of a violent offense, which occurred on or after July 1, 2023, and the combination of the strikes allocated pursuant to this section for the violent offense and the defendant's prior convictions equals three (3) or more strikes; provided, however, that at least two (2) of the strikes must be for offenses listed in subdivision (a)(3)(A); and
Repeat violent offender means a person about whom both of the following apply: (1) The person has been convicted of * * * a felony of the first degree * * * a felony of the second degree that involved an attempt to cause serious physical harm to a person or that resulted in serious physical harm to a person. (2) * * * the following applies: (a) The person previously was convicted of or pleaded guilty to, and previously served * * * a prison term for * * * (i) * * * a felony of the first or second degree that resulted in the death of a person or in physical harm to a person * * *."
