Lessee shall only use the Facility for the production of Refined Coal.
If Lessee does not elect to exercise its termination right, a Renewal Term shall automatically commence and this Lease shall continue to renew for successive Renewal Terms thereafter until the termination of the Section 45 Credit for Refined Coal produced by the Facility.
The CCS Parties shall cause Emission Testing to be conducted at the Power Plant using Refined Coal produced at the New Facility.

Thereafter, if the Section 45 Credit for Refined Coal produced by the Facility is extended, Lessee shall be entitled in its sole discretion to terminate this Lease.
In addition, Producer need not agree to any remedial action (and may terminate any remedial action agreed to) that Producer believes, in its sole discretion, could impair or jeopardize the ability of the Refined Coal to qualify for Section 45 Tax Credits.
