The party responsible for any Recurrent Problem will pay the non-breaching party (the “NBP”) an amount calculated as the [*] of Gross Revenue that the NBP would have earned during the total period in which the Recurrent Problem Elements occurred.
The beginning of this period commences [*] after the party that is responsible for the Recurrent Problem initially learns of, or receives notice of, the occurrence of the first Recurrent Problem Element in the Recurrent Problem.

The liability of the party responsible for the Recurrent Problem will not extend beyond the point in time when the responsible party has resolved the final Recurrent Problem Element in the Recurrent Problem and will not include periods when the NBP experiences a technical lapse during a Recurrent Problem Element.
