Reconsideration Request means a written request submitted to the Trust by a Direct Claimant that the Trustees or Individual Review Claim Panel, as applicable, reconsider a Disallowed Claim Notice, a Secondary Election Activation Notice, or, solely with respect to Direct Claims that become Allowed Claims under the Expedited Review Process or the Individual Review Process, an Allowed Claim Notice, as set forth in Section 6.1.1 and Section 6.2, as applicable.

• If the Claims Administrator believes that a Settlement Category different from that selected by Claimant is applicable, after consulting with and receiving confirmation from the Special Master, the Claims Administrator shall assign that Settlement Category to the Claimant, subject to any Claimant’s right to make a Reconsideration Request or take an appeal as set forth in Article XIII–Reconsideration Requests and Appeals.

• The process and procedures for any such Reconsideration Request and appeal are set forth in Article XIII–Reconsideration Request and Appeals.

• The Applicant agrees to pay such fees when due and understands and agrees that MPI has no obligation to commence the testing or re-testing process or consider a Reconsideration Request or an appeal therefrom until the Applicant has paid the applicable Testing Fees and Appeal Fees in full.

• From time to time MPI will set the applicable fees and expenses (“Testing Fees”) for the testing and/or re-testing of each Applicant Product and, if applicable, the applicable fees and expenses (“Appeal Fees”) for any Reconsideration Request, and any appeals therefrom, relating to an Applicant Product.

• The Applicant agrees to pay such fees when due and understands and agrees that MPI has no obligation to commence the testing or re-testing process or consider a Reconsideration Request or an appeal therefrom until the Applicant has paid the applicable Testing Fees and Retesting Fees in full.

• Total Scores not subject to a Tier 4 Reconsideration Request or as adjusted, if appropriate, as the result of a timely Tier 4 Reconsideration Request shall be final and binding as the Final Total Score for purposes of calculating a Verified Tier 4 Primary Plaintiff’s Final Distribution, if any, as set forth in Sections XIII and XV.A of this Agreement, unless the Verified Tier 4 Primary Plaintiff submits an Appeal to the Claims Appeal Neutral pursuant to Section XIV.C of this Agreement.

• The audit shall include a sample from all form types (e.g., 837I (UB facility claims), 837P (HCFA Professional Claims), LTC-01 form, Provider Reconsideration Request Form, etc.).

• Further, the Group believed that its good-faith efforts to resolve this matter informally through Provider Enrollment and submission of the Revalidation Application extended the appeal period, We appreciate your consideration of this Reconsideration Request and hope that you will reverse your revocation of the billing privileges.
