Receiver Order definition

Receiver Order means a ruling, judgment or order that appoints, or that authorizes or permits, the taking of possession by, a receiver, liquidator, assignee, custodian, trustee or sequestrator (or similar official) of the Company or the property or assets of the Company.
Receiver Order means the October 6, 2010 order of the State Court appointing the Receiver.
Receiver Order shall have the meaning set forth on page 1.

  • In the event of a conflict between the terms of this Agreement and the terms of the Receiver Order, the Receiver Order shall control.

  • Notwithstanding the foregoing, it is expressly understood that this Agreement shall be filed of record in the Receivership Action as needed or beneficial to Seller to carry out the Receiver Order and to obtain the Approvals.

  • Notwithstanding anything to the contrary, Seller’s liability, if any, arising in connection with this Agreement or with the Property shall be limited to Seller’s interest in the Property as set forth in the Receiver Order for the recovery of any judgment against Seller, and Seller shall not be personally liable for any such judgment or deficiency after execution thereon, it being understood that the Property is owned by Owner and not by Seller.

  • The Property is currently subject to the Receiver Order entered in the Receivership Action.

  • Nothing in this Agreement shall in any way modify or waive the immunity afforded the Receiver under applicable law and the Receiver Order.

  • The Stipulation for entry of the Stipulated Receiver Order shall have been executed by Obligors counsel of record in the Action.

  • Subject to the entry of an order approving this Agreement and the Receiver Order, the Receiver has the relevant power to execute and deliver this Agreement and to consummate the transactions provided for herein.

Related to Receiver Order

  • Levy Order means an Order made by the Commission under paragraph 16 of the Schedule to the Act.

  • Bankruptcy Order means any court order made in a proceeding pursuant to or within the meaning of any Bankruptcy Law, containing an adjudication of bankruptcy or insolvency, or providing for liquidation, winding-up, dissolution or reorganization, or appointing a Custodian of a debtor or of all or any substantial part of a debtor’s property, or providing for the staying, arrangement, adjustment or compromise of indebtedness or other relief of a debtor.

  • Depositor Order A written order or request, respectively, signed in the name of the Depositor by any one of its Executive Officers.

  • Customer Order means, with respect to a Participant or Authorized Trader, an Order or Request for Quote that has been provided to such Participant or Authorized Trader, as applicable, by or on behalf of a Customer.

  • Issuer Order and “Issuer Request” means a written order or request of the Issuer signed in the name of the Issuer by any one of its Authorized Officers and delivered to the Indenture Trustee.
