Any reference herein to “check” shall refer to each and every check or item that is transmitted to us by you using the RDC Service, both individually and collectively.
You agree that you will use the RDC Service only to scan and transmit images of “checks”, as that term is defined in Regulation CC of the Board of Governors of the Federal Reserve System, for a deposit to your Account.
We may from time to time impose or change limits on your use of the RDC Service, including but not limited to, limits on the dollar amount and/or the number of checks you may transmit using the RDC Service.
You agree that the image of any check that is transmitted via the RDC Service shall be deemed an “item” within the meaning of Article 4 of the Uniform Commercial Code as adopted in Maine.
We may from time to time limit or prohibit the use of the RDC Service for deposits to certain account types, at our sole discretion.
You understand that, at your sole cost and expense, you must use a compatible mobile device that meets all technical requirements for the proper delivery of the RDC Service.
You must continue to qualify for the RDC Service, and we reserve the right to change the qualifications at any time without prior notice to you.
Upon your receipt of a confirmation that we have received and accepted an image (or data extracted from the Checks) that you have transmitted through the RDC Service, you agree to retain the Checks for at least thirty (30) calendar days from the date of the image transmission (“Retention Period”).
You acknowledge and agree that Avadian, in its sole discretion, may establish limits on the dollar amount (e.g., per item and per day) that you may submit for deposit through the RDC Service.
When you use the Mobile Remote Deposit Capture Service to transmit a check image to us, you agree to supply the following information on the back of each check in the space provided for endorsements: (i) the following restrictive verbiage: “For Regions Mobile RDC Service Only”, (ii) if you are using the Service to make a deposit to your Mobile RDC Account, your Mobile RDC Account number, and (iii) your legally-binding signature to endorse the check.
