For avoidance of doubt, approved Expenditures not recoverable during the tariff freeze period shall be, in part or in its entirety, considered as recoverable Expenditures in subsequent Rate Rebasing exercises as determined and approved by the Regulatory Office.

The Concessionaire shall, at each Rate Rebasing Date, submit to the Regulatory Office a list of all Recovered Assets, including all supporting documents.
The Concessionaire shall post and maintain, throughout the Concession Period, a bond, bank guarantee or other security acceptable to MWSS (a “Performance Bond”) in favor of MWSS to secure the Concessionaire’s performance of its obligations under this Agreement during the Rate Rebasing Period commencing on that date.
