The State is also entitled to verify the second till the sixth Bird Radar System before accepting them.
For purposes of this Agreement, “Total Gross Revenue” shall mean the sum of all Radar System Revenue, Software Revenue, Services Revenue, and Delivery Systems and Payloads Revenue.
If a Bird Radar System (or its subsystems) and/or services that meet the terms of the Agreement are not delivered and/or not rendered, respectively, at the agreed place and the agreed time, the State can require the Supplier to deliver the missing Bird Radar System (or its subsystem) or to restore or replace the Bird Radar System (or its subsystem) or to render the services properly.

If a Bird Radar System is returned to the Supplier, the risk of loss and/or damage to the Bird Radar System shall rest with the State until the moment that the Bird Radar System has been returned to the Supplier, unless the State proves that the loss or damage is attributable to Supplier or the result of an unforeseen external cause.
The State shall notify the Supplier within one week of the verification which shortcomings have been found in the verified Bird Radar System.
In the Ground Prediction Radar System scheme as shown in Figure 52, radar control and data acquisition is performed by a single board, called Digital Antenna Driver (DAD).
Such verification shall start within one week of the Bird Radar System being made available.
After receiving notification from the State, the Supplier undertakes to immediately start modifying the Bird Radar System in such a way that the shortcomings that were identified no longer occur.
