DAP Shipment definition
DAP Shipment means a consignment of Biomass shipped on board truck(s) or rail car(s) and delivered by Seller to Buyer hereunder.
Examples of DAP Shipment in a sentence
Notwithstanding anything in Section 8 of the Agreement or otherwise to the contrary, for any trucks exceeding the allowable gross weight established by Applicable Law, the weight of the applicable DAP Shipment for purposes of determining the Purchase Price shall be reduced by the amount of such exceedance.
The weight of each DAP Shipment shall be determined at the Delivery Point at Buyer’s expense by the net scaled weight of truckloads or rail cars, as applicable, delivering the relevant DAP Shipment(s).
Buyer shall, promptly after weighing of each DAP Shipment, provide Seller with a certificate certifying the weight of such DAP Shipment as determined pursuant to this Section 8(a) (the “DAP Weight Certificate”).
