Qualified Spouse definition

Qualified Spouse means the spouse to whom the Participant was married on the date of the Participant’s death and had been married throughout the one year ending with the date of the Participant’s Annuity Starting Date or, if earlier, the date of death. A spouse is also a “Qualified Spouse” if the Participant and spouse became married within the year immediately preceding the Participant’s Annuity Starting Date and they were married for at least a year before his death. Effective June 26, 2013, a couple is married, regardless of gender, if their marriage occurred in a jurisdiction which recognized their marriage as legal, regardless of the current domicile of the parties.
Qualified Spouse means the legal spouse of a Participant, who has been married to the Member for at least a one year period ending on the Participant's date of death or Termination, if later.
Qualified Spouse means the unmarried widow (or widower) of a deceased Member or Retiree who (a) was married to the deceased Member before his or her retirement; or, (b) if married after the Member's retirement, the unmarried widow (or widower) of a deceased Retiree shall have been married to the Retiree at least two (2) years prior to his death.

Examples of Qualified Spouse in a sentence

  • Qualified Spouse: A monthly allowance commencing at age 62, except that the benefit is payable immediately if: (1) the qualified deceased member had 10 or more years of Ohio service credit; or (2) is caring for a surviving child, or (3) is incompetent.

  • The monthly amount of the pension benefit, once it has become payable, shall not be increased if the Qualified Spouse is subsequently divorced from the Pensioner.

More Definitions of Qualified Spouse

Qualified Spouse means the individual of the opposite sex to whom a Participant is legally married for at least twelve (12) months on his or her Annuity Starting Date or his or her date of death, whichever occurs first, or who otherwise qualifies as a Qualified Spouse under the Retirement Plan. A domestic partner may not be a Qualified Spouse.
Qualified Spouse means (1) a spouse who is legally married to you throughout the one year period immediately before your Annuity Starting Date or, if earlier, before your death; or (2) if you have been married for less than one year on your Annuity Starting Date, a spouse who is legally married to you on your Annuity Starting Date and for at least one year before your death; or (3) your former spouse who is designated as your Qualified Spouse by a QDRO.Effective June 26, 2013, the determination of a lawful marriage will be made without regard to sex. A “spouse” does not include a person who has entered into a registered domestic partnership, civil union or other formal relationship with you that is not denominated as a marriage.
Qualified Spouse means a person to whom a Participant is considered married for at least one year prior to the commencement of his retirement or his death, if earlier, under applicable law and, if and to the extent provided in a Qualified Domestic Relations Order (within the meaning of Section 206(d) of the Employee Retirement Income Act of 1974 (otherwise referred to as ERISA) and 414(p) of the Code), a Participant’s former Spouse.
Qualified Spouse as used in this Schedule II shall mean a Participant's lawful husband or wife, as the case may be, recognized under the laws of the state, or other applicable Jurisdiction, in which the Participant regularly and continuously is employed by the Company. The Company, Committee, Plan Administrator and applicable insurance company may rely on the statement of a Participant concerning the Participant's marital status and all persons claiming any benefit under the Plan shall be bound by such representation.
Qualified Spouse means a Spouse or former Spouse of a Participant as identified and described in Sections 5.01 for purposes of Article V.

  • Eligible Spouse means a spouse of an Eligible Retiree who satisfies the requirements for eligibility described in the Eligibility section of this document, or an ex-spouse who is an Eligible Spouse with rights to coverage as an Eligible Spouse pursuant to a court order recognized by SHARP. A Spouse must be married to retiree at least one year prior to the effective date of retirement.   • Institutionalized spouse means a married person living in a medical institution, or nursing facility, or home- and community-based waiver setting who is likely to remain living in these circumstances for at least 30 consecutive days, and whose spouse is not in a medical institution or nursing facility for the purposes of rules 441—75.5(249A), 441—75.16(249A), and 441—76.10(249A). “Local office” shall mean the county office of the department of human services or the mental health

  • Community spouse means a spouse of an institutionalized spouse for the purposes of rules 441—75.5(249A), 441—75.16(249A), and 441—76.10(249A).

  • Designated Beneficiary means the beneficiary or beneficiaries the Participant designates, in a manner the Administrator determines, to receive amounts due or exercise the Participant’s rights if the Participant dies or becomes incapacitated. Without a Participant’s effective designation, “Designated Beneficiary” will mean the Participant’s estate.
