Misuse includes creating multiple or false profiles, infringing any Intellectual Property rights, violating any of the terms and conditions of this Agreement, or any other behaviour that QIPL, in its sole discretion, deems contrary to its purpose.
In case generic tapes are used in the packaging/sealing of the goods/shipments, QIPL shall have no responsibility of any kind, in case of pilferage/damaged/alteration/tapering/leakage etc.
In this regard, the User agrees that QIPL shall have the right to deduct the freight charges from the COD Amounts received by QIPL, and then remit/reimburse the balance amount to the User.
The User hereby agrees that if the User wishes to use the QUIXGO platform for shipping documents/letters/likewise items, then the User shall use the said services only pursuant to agreeing with QIPL the terms and conditions related to shipping of documents.
In case, the User does not book any shipmentfor a continuous period of 3 years, then QIPL shall have an unconditional right to forfeit such credit balance in the QUIXGO wallet after the expiry of 3 years from the last shipmentdate.
In the event QIPL believes that you are shipping (or have shipped) goods/shipments wherein the declared weight differs and is less or greater than the actual weight, then QIPL would inter- alia havethe right to retain the custody of (and subsequently dispose within 30 days of retention) such shipments and to levy damages/charges (along with the applicable GST amount) on you of Rs.1,00,000/- (Rupees One Lac only) per shipment or of such other amount as decided by QIPLin its sole discretion.
Unless otherwise decided by QIPL, the annexures containing specific terms of use supersedes all general terms of the Agreement, previous letters of intent, heads of terms, prior discussions and correspondence exchanged between the Parties in connection with the Agreement referred to herein.
During this notice period, QIPL will investigate and ascertain the fulfilment of any ongoing Services and pending dues related to fees or any other amount payable by the User.
In addition, QIPL would inter-alia have the right to retain the custody of such shipments (including opening, inspecting and subsequently disposing of shipments within 30 days of retention) and to levy damages/charges (along with the applicable GST amount and freight charges) of Rs. 1,00,000/- (Rupees One Lac only) per incident/shipment or of such other amount as decided by QIPL in its sole discretion.
In this regard, QIPL has a zero tolerance policy with respect to counterfeit or fraud products/shipments (including products/shipments which are misrepresented in their origin or quality, or which are fake, cloned, duplicate or likewise products/shipments).
