Putative Class Members means all Persons who are within the scope of the definition of “Settlement Class,” including those who validly and timely request exclusion from the Settlement Class, as provided in this Settlement Agreement.

Examples of Putative Class Members in a sentence

  • Not later than (10) business days after receipt of the Putative Class List, the Claims Administrator shall also email a copy of the Class Notice to all Putative Class Members whose email addresses are known.

  • Putative Class Members wishing to opt out of the Settlement must send to the Settlement Administrator by U.S. Mail a personally signed letter including their name and address, and providing a clear statement communicating that they elect to be excluded from the Class.

  • Putative Class Members who do not oppose the proposed Settlement but do not wish to participate in it or release their claims may opt-out of the proposed Settlement (see “Opting-Out” below).

  • For its part, Defendant agrees that it shall not discourage Putative Class Members from participating in the settlement and shall refer any questions to the Settlement Administrator.

  • Putative Class Members requesting exclusion from the Settlement Class shall be requested to provide the following information to the Administrator: (i) name, (ii) address, (iii) telephone number, (iv) number and type of AIG Securities purchased (or otherwise acquired) or sold during the Class Period, (v) prices or other consideration paid or received for such AIG Securities, and (vi) the date of each transaction.

  • If the number of Putative Class Members who opt-out does exceed more than 2% of the Putative Class Members contained in the Ionic Breeze® Database, Settling Defendant shall have the right to terminate this Agreement.

  • Settlement Class Members, Plaintiffs, and Settlement Class Counsel expressly concur and agree that Settling Defendant is entitled to communicate with the Putative Class Members, except as it relates to this Class Action (other than as provided in this Agreement).

  • In addition, it is expressly agreed that this Agreement shall survive and remain in full force and effect as the Stockholder Agreement of the Surviving Corporation (as defined within Merger Agreement) upon consummation of the Merger.

  • Those Putative Class Members who have chosen not to get the Sharper Image catalog but are contained within the Ionic Breeze® Database will get individualized notice by mail.

  • The initial calculation prior to the mailing of the Class Notice shall estimate (1) the gross Individual Settlement Payment that each Settlement Class Member may be eligible to receive, assuming that no Putative Class Members opt out of the Class Settlement and that all Settlement Class Members negotiate their Individual Settlement Payment checks; and (2) the gross PAGA Payment that each PAGA Releasee may be eligible to receive.


More Definitions of Putative Class Members

Putative Class Members means any current or former non-exempt employee of Defendant working in Sprint’s retail establishments in the states of Arizona, Colorado, New York, Ohio, and Washington during the applica ble Settlement Period.
