PURCHASER'S INITIALS. MG/ ----------- Notwithstanding anything to the contrary contained in this Section 11.3, Purchaser does not release Seller from (i) any of Seller's representations, warranties and covenants in the Transaction Documents; (ii) Claims by Purchaser for contribution as a direct result of any action brought against Purchaser by any third party (including, without limitation, any governmental authority with jurisdiction over the Property, any tenant or other occupant of the Property, any adjacent property owner or any lender holding a security interest in all or any portion of the Property) to the extent such Claims arise out of the release of Hazardous Materials on or under the Property that occurred during the period of time that Seller owned the Property, or (iii) any act of Seller constituting fraud or a criminal act; provided further, however, that nothing in this sentence is intended to expand or increase Seller's liability beyond that provided for in any Laws regarding Hazardous Materials or to constitute a representation or warranty as to the environmental condition of the Property other than as expressly set forth in Section 9.1.4.
