This Agreement does not modify the Plan Approval or approval of the PUD-C overlay for the Property.
The PUD-C overlay requires that a preliminary PUD development plan and one or more final PUD development plan(s) be submitted for development within the Property, and that such development occur in accordance with the Commercial Development Design Standards and Guidelines (“CDDSG”) and PUD-C standards and criteria in the LMC, subject to such waivers or modifications of applicable requirements as are approved through the PUD development plan approval process.
