Public Improvement Projects means any project for the erection, construction, alteration, repair or improvement of any public structure, building, road, or other public improvement of any kind.

Public Improvement Projects means a project for construction, reconstruction or major renovation on real property by or for a contracting agency. “Public improvement” does not include: (i)Projects for which no funds of a contracting agency are directly or indirectly used, except for participation that is incidental or related primarily to project design or inspection; or (ii)Emergency work, minor alteration, ordinary repair or maintenance necessary to preserve a public improvement. Prevailing Wage rates required to be paid to Contractor’s workers will be determined based on the execution date of the applicable Task Order for each perspective Public Improvement Project, not based on the execution date of this Agreement. The City will pay to Contractor the applicable “BOLI Rate” as indicated on Exhibit B. That “BOLI Rate” will be protected from increase for Year 1 of the Agreement. Any notice of an increase in the fees shall be given to the City at least sixty (60) days prior to an anniversary date of this Agreement. The adjustment is limited to the lesser of the increase in Contractor’s published BOLI Rates charged to all clients for services similar to those Services described in this Agreement, or the increase in the Consumer Price Index (CPI) (All Urban Consumers), West – Size Class B/C as of the anniversary date over the index prior to the commencement date of this Contract. The proposed rate adjustment cannot result in an increase to the not-to- exceed amount of any on-going Task Order. The change is subject to review and acceptance by the City of Bend via contract amendment prior to performance of work at new rates. Labor rates not included in Exhibit B will only be effective by fully executed Agreement Amendments.

  • Based upon applications for payment submitted pursuant to Section E of the OSU General Conditions for Public Improvement Projects, Owner shall make progress payments on account of the Preconstruction Fee, Cost of the Work, and associated CM/GC Fee, less 5% retainage, to the CM/GC as provided below and elsewhere in the Contract Documents.
