The terms of this Agreement are subject to the unavoidable delay provisions of Section 25 of the PTUA.

For purposes of this paragraph the WIOs agree not to assert that Section 21 of the PTUA applies in any respect to review of or a decision on the proposed alternative POD.
Subject to and as modified by the terms of this Agreement, the relationship between DNR and the WIOs shall continue to be governed by the PTUA including applicable State law.
