Provisional Value definition

Provisional Value has the meaning set forth in Clause 3.1;

Examples of Provisional Value in a sentence

  • Where the mortgage property is used to compensate for the creditor's rights of Party B, the forgoing said Provisional Value shall not be considered as the basis that the mortgage property compensates for the creditor's rights of Party B.

  • For illustrative purposes only, an example of calculation of the Provisional Value based on the Intermediary Accounts have been attached in Schedule 2B.

  • Once the Parties have agreed on the Final Value, the difference (positive or negative) between the Provisional Value and the Final Value (the “Value Adjustment”) shall be paid according to this Clause 3.4 by the Seller to the Purchaser (or vice versa, as the case may be).

  • If the mortgaged property is used to offset Party B’s credit rights, the above Provisional Value shall not be used as the basis for the mortgaged property to offset Party B’s credit rights.

  • For the value of the mortgaged property as recorded in the "List of Mortgaged Properties" hereunder or as otherwise agreed by the Parties (hereinafter referred to as the "Provisional Value"), no matter whether it has been recorded on the register of the registration authority, it shall not indicate the final value of the mortgaged property, and the final value shall be the net amount of the proceeds from disposal of the mortgaged property by Party B, net of taxes and fees.

  • The value of the mortgage property specified in the List of Mortgage Property under this contract or separately agreed by the parties hereto (hereinafter referred to as the "Provisional Value"), shall not be the final value of the mortgage property, no matter whether or not the Provisional Value is recorded in the registration book of the registration authority.
