Province Change definition

Province Change means any of the following as initiated by the Province:
Province Change means: (a) a variation in the design, quality or scope of the Works or the Decommissioning; (b) a variation in the quality or scope of the Undertakings (other than as referred to in paragraph (a) above); (c) a variation in the Technical Requirements (other than as referred to in paragraphs (a) or (b) above or a change in the Construction Requirements, the Five Year Management Plan, the O&M Requirements, the Traffic Management Requirements, the Concessionaire Proposal Extracts, the Records Management Protocol or the privacy code referred to in Section 14.9 [Privacy Code]);

Examples of Province Change in a sentence

  • Without limiting the generality of the foregoing, the Province may in the exercise of its discretion determine to have any such works carried out by its own labour forces (including day labour retained by the Province) or by a third party contractor or by the Concessionaire (any determination to have such works carried out by the Concessionaire to be notified to the Concessionaire as a Province Change).

  • The issuing of any such instructions will constitute a Province Change and the provisions of Part 2 of Schedule 13 [Province Changes] shall apply.

  • Project Co shall not be entitled to any payment, compensation, extension of time or other relief for a Province Change or Project Co Proposal except (in the case of Minor Works) in accordance with Section 1.2(c) of Schedule 11 [Changes] or (in the case of other Province Changes) to the extent provided in a Change Certificate issued in accordance with Schedule 11 [Changes].

  • The Concessionaire will not be entitled to any compensation for the delay and the delay will not be an event of Force Majeure, Eligible Force Majeure, a Compensation Event or a Province Change.

  • The Concessionaire, except to the extent required by any Province Change, will comply with the provisions of the Technical Requirements and all Laws and Regulations and Legal Requirements in connection with all signage and traffic control devices on or near the Concession Highway.

  • Any requirement to comply imposed by the Province pursuant to this Section 8.14.5 will constitute a Province Change.

  • The Province, acting reasonably, may at any time and from time to time, by written notice to Project Co, add words to the name of any Station or change any words so added, to include specific identification, such as local features, amenities and landmarks, and any such addition or change shall not constitute a Province Change, provided that it is made before the fabrication of permanent signs for such Station.

  • The Concessionaire shall not be entitled to any payment, compensation, extension of time or other relief for a Province Change or Concessionaire Proposal except to the extent provided in a Change Certificate issued in accordance with Schedule 11 [Changes].
