Protected Names definition

Protected Names has the meaning ascribed to it in Clause 3.8.6;

Protected Names. As defined in Section 27.13.

Protected Names means the names “Posthouse”, “Holiday Inn”, “Express by Holiday Inn”, “Crowne Plaza”, “InterContinental”, “Indigo”, “Spirit”, “Staybridge Suites”, “Prestige Reservations” and “Candlewood Suites” or any other trade name(s) or trade or service mxxx (a) owned by or exclusively licensed to any of the Seller’s Group or any member thereof or (b) associated with or at any time used in connection with the “Posthouse”, “Holiday Inn”, “Express by Holiday Inn”, “Crowne Plaza”, “InterContinental”, “Indigo”, “Spirit”, “Staybridge Suites”, “Prestige Reservations” and “Candlewood Suites” brands or any combination or colourable imitation thereof in either case in all cases as registered or used at the Completion Date;

Examples of Protected Names in a sentence

• In circumstances where the Operator utilises any of the Protected Names, either singularly or in combination or association with any other name, it does so only in terms of the PPP Agreement and on termination of the PPP Agreement, the Operator shall not be entitled to operate or conduct any business using the Protected Name in combination or association with any other name.

More Definitions of Protected Names

Protected Names means the mechanism by which the Registry may reserve certain names in order to extend additional rights protection for certain categories of Applicants.

Protected Names means the names “Hyatt”, “Grand” and “Regency” and any other name that includes the word “Hyatt (such as, for example and without limitation, “Hyatt Regency,” “Grand Hyatt,” “Park Hyatt,” “Hyatt Place,” “Hyatt House,” “Hyatt Ziva,” “Hyatt Centric,” “Hyatt Zilara,” “a Concept by Hyatt,” or “World of Hyatt,”) either alone or in conjunction with another word or words, or any name or mark that is comprised of or confusingly similar to any of the foregoing, “Andaz”, “The Unbound Collection by Hyatt,” “Ziva,” “Zilara,” “Miraval,” “a Concept by Hyatt,” “World of Hyatt,” or any other name used in the operation of the hotels operated or managed by Hyatt or any Affiliate thereof, including, without limitation, the names “Tanglewood”, “Tarpon Bay”, “Corkscrew”, “Mangroves”, “Cool Beans”, “Stillwater Spa”, “Ka’ana Kitchen”, “Mokapu Market”, “Bumbye Beach Bar”, “Lehua Lounge”, “Andaz Beach Crew”, “ ‘Awili Spa”, “One Up Lounge” and “One Up Restaurant”.

Protected Names means the names “Hyatt”, “Grand” and “Regency” and any other name that includes the word “Hyatt (such as, for example and without limitation, “Hyatt Regency,” “Grand Hyatt,” “Park Hyatt,” “Hyatt Place,” “Hyatt House,” “Xxxxx Xxxx,” “Hyatt Centric,” “Hyatt Zilara,” “a Concept by Hyatt,” or “World of Hyatt,”) either alone or in conjunction with another word or words, or any name or xxxx that is comprised of or confusingly similar to any of the foregoing, “Andaz”, “The Unbound Collection by Hyatt,” “Ziva,” “Zilara,” “Miraval,” “a Concept by Hyatt,” “World of Hyatt,” or any other name used in the operation of the hotels operated or managed by Hyatt or any Affiliate thereof, including, without limitation, the names “Tanglewood”, “Tarpon Bay”, “Corkscrew”, “Mangroves”, “Cool Beans”, “Stillwater Spa”, “Ka’xxx Kitchen”, “Mokapu Market”, “Bumbye Beach Bar”, “Lehua Lounge”, “Andaz Beach Crew”, “ ‘Awili Spa”, “One Up Lounge” and “One Up Restaurant”.

Protected Names the names of the Kgalagadi Transfrontier Park, the Khomani San Community and the Xxxx Community or any names associated with the Park, the Khomani San Community and/or the Xxxx Community;

Protected Names means the names “Hyatt” and “Regency” and any other name that includes the word “Hyatt” (such as, for example and without limitation, “Hyatt Regency” or “Grand Hyatt” or “Park Hyatt”) either alone or in conjunction with another word or words or any other name used in the operation of other hotels and resorts owned, operated or licensed by Manager or any Affiliate thereof, including, without limitation, “Gold Passport®” or “Andaz.”

Protected Names means the names “Hyatt” and “Regency” and any other name that includes the word “Hyatt” (such as, for example and without limitation, “Hyatt Regency,” “Grand Hyatt,” “Park Hyatt,” “Hyatt Place,” “Hyatt House,” “Hyatt Zixx,” “Xxxxt Centric”, “Hyatt Zilara,” or “World of Hyatt,”) either alone or in conjunction with another word or words, or any name or mark thax xx comprised of or confusingly similar to any of the foregoing, “Andaz”, “The Unbound Collection by Hyatt”, “Ziva,” “Zilara,” “Miraval,” “World of,” or any other name used in the operation of the hotels operated or managed by Manager or any Affiliate thereof (other than Seller). Under no circumstances shall the names “Royal Palms” and “T. Cook’x” xx xxxmed to be Protected Names.
