Ensure that all activities are performed in accordance with the NBL External Customer Policy (CX12-POL0011) and as documented in activity specific test plans and procedures, Project Concept and Safety Reviews (PCSR) and Readiness Reviews (RR) consisting of Hardware RR (HRR), System RR (SRR), Test RR (TRR), and Operational RR (▇▇▇).
All contents of this Project Concept document and any proposal, concept, designs, materials and work product of any kind developed by CCC or members of the CCC Team are the sole and exclusive property of CCC or the relevant member of the CCC Team, are non-binding and are intended solely for purposes of discussion and negotiation with the Government of Bermuda.
The Project Concept, as developed by members of the CCC Team, is presented in the following main categories: Traffic, Design, Construction, Project Structure, Operations, Commercial, Financial, the CCC Value Proposition and Value for Money & Adherence to Green Book Principles.
The technical, commercial and financial concepts, figures and data in the Airport Project Concept document, while based on extensive due diligence and analysis, are indicative only and provided for purposes of discussion and future negotiation.
If the Agency gives written notice of specific objections to or deficiencies in any proposed changes to the Project Concept submitted by Developer to the Agency, Developer and the Agency agree to exercise their best efforts to diligently and reasonably initiate and complete negotiations or changes thereto acceptable to both parties within a reasonable period after receipt by Developer of such objection or deficiency notice but in no event longer than thirty (30) days.
The Agency has reviewed the Project Concept and by approving and executing this Agreement does approve the Project Concept.
No Agency review of the Construction Drawings is required unless material changes are proposed to the Project Concept.
The Parties intend to cooperate to develop the Project as generally described in the Project Concept, in order to remedy the blighted conditions set forth in the Urban Renewal Plan and to secure the economic development benefits resulting therefrom.
Based on the Project Concept Documents, the Contractor shall prepare, for review and approval by the Owner, complete "Schematic Design Documents" consisting of drawings and other documents illustrating the scale and relationship of the various components of the Project, and outlining the general nature of the structural elements of the Project.
If the City Manager disapproves the Preliminary Plans and Specifications, then Fortress Secured shall within thirty (30) days after such disapproval, submit a revised modification to the Preliminary Plans and Specifications that substantially conform to the Project Concept Plan to the City Manager pursuant to the foregoing process until such Preliminary Plans and Specifications for such Phase have been approved by the City Manager.
