Subject to the provisions of the Contract, where any Progress Certificate certifies amounts due from the Principal to the Contractor, following receipt by the Principal of a properly completed and valid Progress Payment Instruction(s) and Payment Report, the Principal must pay the amount shown in the Progress Certificate into the Project Bank Account within the time for payment specified in item 6 of Appendix A.
If the Superintendent fails to issue a Progress Certificate within fourteen (14) days, the Superintendent is deemed to determined, at the end of the fourteen (14) day period that the milestone has not been attained.
The Superintendent shall, within fourteen (14) days of receipt of a Payment Claim, determine (and notify the Contractor of its determination) whether that milestone has been attained, and if so, the amount payable by the Principal to the Contractor, being that portion of the Contract Price mentioned opposite such Works in column “B” of the table (which is inclusive of GST), having taken into account any adjustments in accordance with clause 29.3 (Progress Certificate).

Payment of a milestone payment shall be made by the Principal within fourteen (14) days after the issue of the Progress Certificate.
If upon receipt of such further information SCCL no longer disputes any aspect of the Progress Certificate, SCCL shall approve the Progress Certificate without delay.
If SCCL disputes any aspect of a Progress Certificate, it shall within 10 working days after receipt of the Progress Certificate notify the TPO in writing of all aspects that it disputes, and to the extent to which it is able to calculate them, provide details of the adjustments that it requires.
The net amount of the amount certified for payment in the Progress Certificate and the certificate issued in accordance is clause 15.4(b) above (if any) is the ‘Scheduled Amount’.
NRHA shall have submitted to Eureka County the properly completed and executed Progress Certificate and Request for Payment reports in the forms at Attachment F, and such reports shall have been approved by the Eureka County Public Works Director.
The request must include the Progress Certificate and Request for Payment reports in the forms at Attachment E.
