Production Threshold definition

Production Threshold means, during a consecutive 60-day period, Borrower shall have produced no less than 80% of the amounts set forth in the Base Case Projections for Borrower’s clean ton coal production for the 2012 calendar year allocated on a pro rata basis for 60 days.

Examples of Production Threshold in a sentence

  • Except as otherwise expressly stated in Section 12 of the General Terms and Conditions, the Shortfall Payment shall be Customer’s sole and exclusive remedy for Seller’s failure to produce the Minimum Production Threshold during the Guarantee Term.

For the avoidance of doubt, after the Flip Date occurs, the Production Threshold will be zero.
