Production Incentives definition

Production Incentives shall have the meaning set forth in the Tax Matters Agreement.
Production Incentives means production Tax credits, rebates or refunds, production incentives, production receivables or similar items, however denominated, including any credit, rebate, refund, incentive or receivable, in each case arising anywhere in the world that is based upon or otherwise arises in relation to the film, television, games or other production activities of the Company Business or the SpinCo Business, as applicable, whether or not reflected on a Tax Return and whether or not payable in cash, as a refund, as a credit, as an offset of Taxes or otherwise.
Production Incentives means the Production Incentives that are made available in terms of the APDP;

Examples of Production Incentives in a sentence

  • The annual WA State Production Incentives will be paid to the Participant once per year after the Utility receives the applicable tax credit from the State of Washington for this Program.

  • Each of the Scrubgrass Plant and the Panther Creek Plant is exempt from the size limitations applicable to qualifying small power production facilities in 18 C.F.R. § 292.204(a) pursuant to the Solar, Wind, Waste, and Geothermal Power Production Incentives Act of 1990.

  • No WA State Production Incentives will be paid for generated energy after June 30, 2029.

  • Company’s audit and inspection rights in connection with Producer’s books, accounts, and records in connection with the Series will extend and separately apply to any Production Incentives (i.e., Company may separately audit Producer’s books, accounts, and records relating to any Production Incentives in accordance with Section 8 of the Standard Terms to this Agreement).

  • Company’s sole and exclusive right, title, and interest in and to any and all Production Incentives as well as Producer’s obligations in connection therewith (including, without limitation, payment and remittance obligations) will survive the expiration or earlier termination of this Agreement.


More Definitions of Production Incentives

Production Incentives any (i) national, provincial, state, and local tax credits, grants, or other tax incentives; (ii) other lower carbon or clean fuel credits or incentives; (iii) any tax credits or other benefits available to Seller, including without limitation under Internal Revenue Code section 45Z (the Clean Fuel Production Credit) and Blenders Tax Credit; any tax credit generated in connection with production of hydrogen; any tax credit generated in connection with carbon capture, utilization or sequestration; renewable fuel volume obligations under the Renewable Fuel Standard Program under the Energy Policy Act of 2005 and the Energy Independence and Security Act of 2007; UK RTFO, EU RED III, or successor programs; and Canada’s tax laws in respect of Canadian Renewable and Conservation Expenses, or any other similar programs in the applicable jurisdiction; and (iv) any pipeline or fuel transmission tariff-based credits which may be available to Seller.
Production Incentives means actual cash proceeds received by the Company or the Members or their Affiliates attributable to production tax credits or rebates, government subsidies, and the like relating to production of the Picture.
