Privacy and Security Rules definition
Privacy and Security Rules shall have the meaning set forth in Section 7.31(i).
Privacy and Security Rules means the Standards for Privacy of Individually Identifiable Health Information and the Security Standards for the Protection of Electronic Protected Health Information set out in 45 CFR part 160 and part 164, subparts A and E.

If any Privacy and Security Rules require a Party to independently notify a third party of an Information Security Incident to the extent affecting Personal Information or Confidential Information provided or made available to such Party by or on behalf of the other Party, and do not permit such Party to delegate such duty to the other Party, such Party will inform the other Party in writing of such obligation prior to notifying the third party.
Where Provider believes that compliance with any instruction from Recipient infringes any Privacy and Security Rules, Provider shall immediately notify Recipient.
