Priority Hiring definition

Priority Hiring. Pool shall refer to the pool of Displaced Teachers, with effective ratings, who are given the first opportunity to interview for available positions for which they are qualified.
Priority Hiring pool" means a subgroup of Displaced Teachers who were actively employed and deemed satisfactory or effective in their performance evaluation preceding their displacement and who have not secured a new assignment pursuant to Section 11.1 above.
Priority Hiring. Jobs will be offered at the Hotel in accordance with the terms of this letter agreement to those eligible former employees whose names appear on the Priority Hiring List prior to such jobs being offered to any other applicant. Employees hired from the Priority Hiring List shall be considered new employees with no residual rights from their former employment. This is not a recall. Upon receipt of the WARN Notice the Union will present to the Employer a list of employees who desire priority hiring in accordance with the terms of this side letter. The list shall include for each employee the name, social security number, the address and the job title held by the employee on the date of the WARN Notice. It will be the Union’s responsibility to keep the Employer notified of each employee’s last known address during the period of shutdown. In order to be listed on the Priority Hiring List, a Regular, Relief or Steady Extra employee must have two (2) years of continuous service on the date that falls one hundred and twenty (120) days immediately preceding the service of the WARN Notice. In addition, the employee must be on the active payroll on that date. The Employer’s obligation is to offer employment to employees entitled to Priority Hiring for any job that falls within the same “Job Family” that includes the employee’s job title. The “Job Family” consists of those job titles that are listed under the following six (6) contractual headings:

  • Any non-probationary teacher who is displaced and placed on unpaid leave from the District as part of a general or program RIF will be placed on a Priority Hiring List for a period of two (2) years from the effective date of the lay-off.

  • A Displaced Teacher in the Priority Hiring Pool may be invited to participate in additional interviews (beyond the three (3) guaranteed interviews as outlined in Article 19.4.1) if the Principal at the school with the vacancy offers the Displaced Teacher an opportunity to interview.

Priority Hiring considerations: For contracts in excess of $200,000, the contractor, in accordance with the California Public Contracting Code § 10353, shall consider filling vacancies in positions funded by the contract to qualified recipients of aid under Chapter 2 (commencing with Section 11200) of Part 3 of Division 9 of the Welfare and Institutions Code, in accordance with Article 3.9 (commencing with Section 11349) of Chapter 2 of Part 3 of Division 9 of the Welfare and Institutions Code. This section and Article 3.9 (commencing with Section 11349) of Chapter 2 of Part 3 of Division 9 of the Welfare and Institutions Code shall not be applicable to any contracts for a grant as defined in Section 10105. (Section 10105 defines a grant as “. . . the erection, construction, alteration, repair or improvement of any state structure, building, road, or other state improvement of any kind which will exceed a total cost calculated pursuant to subdivision (b).” This section and Article 3.9 (commencing with Section 11349) of Chapter 2 of Part 3 of Division 9 of the Welfare and Institutions Code shall not be construed so as to do any of the following: a. Interfere with or create a violation of the terms of valid collective bargaining agreements. b. Require the contractor to hire an unqualified recipient of aid. c. Interfere with, or create a violation of, any federal affirmative action obligation of a contractor for hiring disabled veterans or veterans of the Vietnam era. d. Interfere with, or create a violation of, the requirements of Section 12990 of the Government Code. (Reference: PCC § 10353)

Teachers in the priority hiring pool shall receive an opportunity to interview for available positions for which they are qualified within the district.
