Predominance definition
Predominance or “Predominant” shall mean no less than 80% of merchandising space allocated to Beverages, always first-position eye-level compared to any and all other Beverages other than those provided by the Contractor.
Predominance is the test generally used by courts to 9 determine whether hybrid transactions are sales of goods 10 under UCC Art. 2. Presumably the same idea will be applied 11 to leases under UCC Art. 2A. 12
