Notwithstanding any provision in any Transaction Document relating to the conditions in this Agreement, the obligation of each Bank to make its Commitments available shall be subject to the condition that the Agent, or its duly authorised representative, shall have received, not later than the First Drawdown Date, the documents and evidence specified in schedule 3 in the agreed form or, if there is no agreed form at the date of this Agreement, in form and substance reasonably satisfactory to the Agent.
