Pre-Grievance definition

Pre-Grievance. A member with a potential grievance, along with an Association representative of the member’s choosing, may seek out her or his supervisor and attempt to resolve a potential grievance verbally before the thirty (30) day time limit for filing at Level One lapses. Level One. Most building based members will file Level One grievances with their building principal. Itinerant staff or staff assigned to no school building will have a Director with whom they will file Level One Grievances. The term “supervisor” as used in this procedure means building principals or an individual member’s directly responsible district level Director. The Director of Health, Safety, and Equity Programs will file her or his grievance with the Superintendent. Level Two. If the grievance is not resolved to the satisfaction of the grievant or the Association within five (5) days after meeting with the supervisor at Level One, the teacher or the Association may present the grievance in writing to the Superintendent or her or his designee(s) within five (5) days of receiving the written response or following the date such decision was due if no decision was received. The Superintendent will meet with the member and an Association representative of the member’s choosing within five Level Three. If the grievance is not resolved to the satisfaction of the grievant or the Association, the member may present the grievance in writing to the School Committee within five (5) days after the decision of the Superintendent or her or his designee was presented or following the date such decision was due if no decision is received. The School Committee or its designee(s) shall hold the hearing at the next regularly scheduled meeting of the School Committee and may render its decision in writing to the member and to the Association no later than ten (10) days following the date of such hearing. If the grievance involves an Appointing Authority matter, and has not been resolved at Level One or Two, as applicable, the Association may submit the grievance to arbitration and shall not submit the grievance to the School Committee.

A member with a grievance will present it in writing to her or his supervisor either directly or through the Association within thirty (30) days of the grievable event(s), or when the individual or Association became aware of the grievable event(s) or when they should have been aware of the grievable event(s) that led to the complaint. The grievant shall set forth the nature of the grievance, shall specify the section of the Agreement alleged to have been violated, and what relief is sought, and it shall be signed by an Association official and/or by the individual member initiating the grievance (a group of members may have the grievance signed by a designated member). Her or his supervisor will meet with the member and an Association representative of the member’s choosing within five (5) days of receipt of the member’s written grievance. The supervisor will respond with a decision in writing to the member and to the Association within five (5) days of the meeting.

Examples of Pre-Grievance in a sentence

  • If the grievance is not resolved at Pre-Grievance, it must be submitted by a Union ▇▇▇▇▇▇▇ or Union Representative, in writing, to Human Resources, with a copy provided by Human Resources to Allina Labor Relations.

  • Before filing a formal grievance, a Pre-Grievance may be filed with the Director of Faculty Relations (DFR), who shall be notified of the complaint in writing by the faculty member or by a Grievance Committee officer.

  • Unless the Parties expressly agree otherwise, exchanges of information and offers of settlement during the Pre-Grievance Step shall be kept confidential by the participants and shall be deemed to have been made without prejudice, and as such in any subsequent proceedings related to that complaint information shall be presented de novo.

  • Pre-Grievance The employee and/or Union ▇▇▇▇▇▇▇ will discuss the alleged grievance with the employee’s manager in an attempt to resolve the issue.

  • The Association may request a Pre-Grievance Meeting by submitting a written summary of the issue to the aggrieved employee’s Bureau Chief, (with a copy to the designated sworn member of Command Staff, Senior Leadership Team, and the Police Department Human Resources Director) within thirty (30) calendar days of the alleged contract violation.

  • A Pre-Grievance Meeting shall be held within fifteen (15) calendar days of the Association’s submission.

  • The provisions of Level One - Informal Pre-Grievance may be waived by mutual consent of the grievant and the Superintendent, allowing the grievant to commence the grievance at Level Two - Formal Grievance.

  • If the employee chooses to not do the optional Step 1, Pre-Grievance, or the problem was not resolved, then the employee may progress to Step 2, Grievance.

  • The Manager involved with Pre-Grievance shall have fourteen (14) calendar days to respond to the Employee’s concern.

  • Settlements of complaints and grievances at the Pre-Grievance or Step One level will not be of any value in the interpretation of this Agreement nor will they set or be of any value as precedent for the handling of other similar matters, and they will be without prejudice to either the position of the Company or the Union on the issues raised.
