Pre-existing Health Conditions. WARNING - Individuals with head, neck, back or other muscular-skeletal Injuries or disabilities, pregnant women, individuals with pre-existing injuries and health conditions (including participants in casts), small infants, and others who may be susceptible to Injury from falls, bumps or bouncing are not permitted in the unit at any time, General Release/indemnity/hold harmless: c/o , understand and acknowledge that play on an amusement device entails both known and unknown risks including, but not limited to, physical injury from falling, slipping, crashing or colliding, emotional injury, paralysis, distress, damage or death to any participant. I hereby voluntarily and expressly release, indemnify, forever discharge and hold harmless ▇▇▇▇ ▇▇▇▇▇ Party Rentals from any and all liability, claims, demands, causes or rights of action whether personal to me or to a third party, which are in any way connected with participation in this activity, including those allegedly attributable to negligent acts or omissions. Should ▇▇▇▇ ▇▇▇▇▇ Party Rentals or anyone acting on behalf of ▇▇▇▇ ▇▇▇▇▇ Party Rentals be required to incur attorney's fees and costs to enforce this agreement, I expressly agree to indemnify and hold ▇▇▇▇ ▇▇▇▇▇ Party Rentals harmless for all such fees and costs. In the event I, the undersigned, or any of my participants file a lawsuit against ▇▇▇▇ ▇▇▇▇▇ Party Rentals, it is agreed to do so solely in the Washington DC metropolitian area. I agree that if any portion of this agreement is found to be void or unenforceable, the remaining portions shall remain in full force and effect. In consideration of being permitted by ▇▇▇▇ ▇▇▇▇▇ Party Rentals to use its equipment and facilities, the undersigned and it participants agree to indemnify and hold harmless ▇▇▇▇ ▇▇▇▇▇ Party Rentals from any and all claims which are brought by the undersigned and/or their participants and which are in any way connected with such use or participation. A set of Rules and Direction are either displayed on the bounce house/unit(s) or have been provided to the undersigned which I agree to follow and utilize at all times during operation and use of the unit(s). Related to Pre-existing Health Conditions

  • Pre-existing Condition(s) means, in respect of the Insured Person, any Sickness, Disease, Injury, physical, mental or medical condition or physiological degradation, including Congenital Condition, that has existed prior to the Policy Issuance Date or the Policy Effective Date, whichever is the earlier. An ordinary prudent person shall be reasonably aware of a Pre- existing Condition, where -

  • Pre-Existing Condition means an illness, disease, or other condition during the 180 day period immediately prior to the Effective Date of Your coverage for which You or Your Traveling Companion, Business Partner or Family Member: 1) received or received a recommendation for a test, examination, or medical treatment; or 2) took or received a prescription for drugs or medicine. Item (2) of this definition does not apply to a condition which is treated or controlled solely through the taking of prescription drugs or medicine and remains treated or controlled without any adjustment or change in the required prescription throughout the 180 day period before Your coverage is effective under this policy.

  • Pre-existing Medical Condition means any condition which is in existence within one hundred and eighty-two

  • Pre-Existing Materials means the pre- existing materials (a) specified in a Statement of Work, including all documents, data, know-how, methodologies, software and other materials, including computer programs, source code, reports and specifications, or (b) provided by or used by Service Provider in connection with performing the Services, in each case developed or acquired by the Service Provider prior to the commencement of this Agreement.

  • Pre-Existing IPR means any Intellectual Property Rights vested in or licensed to the Customer or the Service Provider prior to or independently of the performance by the Customer or the Service Provider of their obligations under this Contract and in respect of the Customer includes, guidance, specifications, instructions, toolkits, plans, data, drawings, databases, patents, patterns, models and designs.
