Pre-Commencement Phase Services definition

Pre-Commencement Phase Services shall have the meaning as set forth in Section 3.2.

  • The Pre-Commencement Phase Services to be performed under this Contract will commence upon the Effective Date of the Contract and be completed within 60 days thereafter.

  • Within thirty (30) Days after the Notice to Proceed Date, Operator shall submit a proposed budget for the Pre-Commencement Phase Services, substantially in the form of Exhibit C, for Owner's review and approval.

  • In respect of the Pre-Commencement Phase Services performed during the period prior to the date of the Commencement Agreement, the Employer shall pay the Contractor the Pre-Commencement Phase Fee set out in Schedule 1 in accordance with the payment provisions set out in the NEC Conditions.

  • As the sole and exclusive compensation and reimbursement to Operator for the performance of the Work hereunder, Owner shall pay Operator, in the manner and at the times specified in this Article VI, all Reimbursable Costs, the Pre-Commencement Phase Services Fee and the Management Fee.

  • Until such time as Operator receives such instructions, Operator shall continue to perform the Pre-Commencement Phase Services according to the terms of this Agreement as permitted under the Pre-Commencement Phase Budget then in effect.

  • The Pre-Commencement Phase Services Fee shall constitute full payment for the services listed in Exhibit D, all Operator overhead and profit for the Work and general and administrative costs incurred by the Operator.

  • During the Pre-Commencement Phase, Operator shall provide the Pre-Commencement Phase Services.

  • The Pre-Commencement Phase Services Fee shall be payable in ten (10) equal monthly installments beginning ten (10) months before the Scheduled Commencement Date and ending on the Commencement Date (provided that if the Commencement Date occurs prior to the end of such ten (10) month period, the balance of the Pre-Commencement Phase Services Fee shall be payable in the month immediately following the month in which the Commencement Date occurs).

  • The Pre-Commencement Phase Services to be performed under this Contract will commence upon the Effective Date of the Contract and be completed within 90 days thereafter.

  • The proposed Pre-Commencement Phase Budget shall be based on Operator's assessment of the required Pre-Commencement Phase Services and reflects the most economical and reasonable means of performing such Services in accordance with the Standards of Performance.

Related to Pre-Commencement Phase Services

  • Construction Phase Services means the coordination, implementation and execution of the Work required by this Agreement, which are further defined in Article 8.

  • Services Commencement Date means the date delivery of the Services shall commence as specified in the Key Provisions. If no date is specified in the Key Provisions this date shall be the Commencement Date;

  • Service Commencement Date means the date the Transmission Provider begins to provide service pursuant to the terms of an executed Service Agreement, or the date the Transmission Provider begins to provide service in accordance with Tariff, Part II, section 15.3 or Tariff, Part III, section 29.1.

  • Billing Commencement Date means the earlier of:

  • Commencement of Commercial Production means: (i) if a mill is located on the Property, the last day of a period of 40 consecutive days in which, for not less than 30 days, the mill processed ore from the Property at 60% of its rated concentrating capacity; or (ii) if a mill is not located on the Property, the last day of a period of 30 consecutive days during which ore has been shipped from the Property on a reasonably regular basis for the purpose of earning revenues, but any period of time during which ore or concentrate is shipped from the Property for testing purposes, or during which milling operations are undertaken as initial tune-up, shall not be taken into account in determining the date of Commencement of Commercial Production;
