Pre-approved Plan definition

Pre-approved Plan shall have the meaning set forth in Section 7(k).
Pre-approved Plan means an advance plan for the Trading of Company Securities that has been approved in accordance with this policy.
Pre-approved Plan means the Pre-Approved Provider’s plan as approved by the IRS.

Examples of Pre-approved Plan in a sentence

  • If a 411(d)(6) protected benefit in the Plan or a plan being merged into the Plan is not permitted in a pre-approved plan, as described in Section 6.03 of Revenue Procedure 2017-41, such provision must be discontinued no later than the date the Employer adopts this Pre-Approved Plan or, in the case of a merger, the merger date and shall apply only to the extent required under Code Section 411(d)(6).

  • The Provider will inform adopting employers of any such amendments or of the discontinuance or abandonment of the Pre-Approved Plan document.

  • Note: If a 411(d)(6) protected benefit in the Plan or a plan being merged into the Plan is not either (1) available as a provision through the Pre-Approved Plan or (2) the subject of a prior determination, advisory or opinion letter, the Employer cannot rely on the Pre-Approved Plan Provider’s opinion letter for qualification with respect to such benefit.

  • The Trustee named in the Adoption Agreement has accepted its appointment, and intends to serve, only for so long as the Employer’s plan is a Pre-Approved Plan.

  • If the Employer's Plan fails to attain or retain qualification, such Plan will no longer participate in this Pre-Approved Plan and will be considered an individually designed plan.

  • This Adoption Agreement and the basic Plan document shall together be known as FIS Business Systems LLC Defined Contribution Pre-Approved Plan #01-002.

  • If the Plan is no longer a Pre-Approved Plan, the Trustee shall resign in accordance with this Section.

  • Upon resignation by or removal of the Trustee, the Employer shall no longer participate in the Fidelity Pre-Approved Plan created by the Non-Trust Plan Documents and shall be deemed to have adopted an individually designed plan.

  • An Employer that amends the Plan for any other reason, including a waiver of the minimum funding requirement under section 412(d) of the Code, will no longer participate in this Pre-Approved Plan and will be considered to have an individually designed Plan.

  • This Adoption Agreement and the basic Plan document will together be known as FIS Business Systems LLC Non-Standardized Employee Stock Ownership (ESOP) Pre-Approved Plan #04-001.
