POSITIVE INTERNET COMPANY definition

POSITIVE INTERNET COMPANY means POSITIVE INTERNET COMPANY Limited (registered in England under number 3673639) whose registered office is Northside House, Mount Pleasant, Barnet. Hertfordshire EN4 9EE; “POSITIVE INTERNET COMPANY Equipment” means the equipment (if any), which is supplied to the Customer or placed at or on a Site by or on behalf of POSITIVE INTERNET COMPANY for the purpose of providing Service under this Contract; “Server Order Form” means the written order form provided by the POSITIVE INTERNET COMPANY and signed and dated by the Customer before the Service commencement. This will represent the final confirmation of prices and minimum service periods; “Service” means the service provided by POSITIVE INTERNET COMPANY whereby the Customer can gain access to the Internet via POSITIVE INTERNET COMPANY's computer network or services, which reside on the POSITIVE INTERNET COMPANY network; and “Site” means the premises at which Service is or is to be provided under this Contract

  • In the event of an Error in Service the Customer must immediately report it by telephone, fax or electronic mail ("fault report") to the appropriate number/e`mail address as notified to it by POSITIVE INTERNET COMPANY for such purpose or such other number as POSITIVE INTERNET COMPANY may from time to time provide to the Customer.

  • Upon receipt of an Error report, POSITIVE INTERNET COMPANY will use its reasonable endeavours to correct the fault as quickly as is reasonably practicable.

  • POSITIVE INTERNET COMPANY specifically excludes and does not give any warranty, assurance or undertaking of whatever nature as to the accuracy or completeness of any data/information received through the Service and the Customer expressly agrees that it will use its own experience, skill and judgement when assessing or relying on any information of whatever nature which it obtains by using the Service.

  • Without prejudice to the generality of the foregoing, the use of any applications which transmit or receive live video, live audio or make similar traffic demands across the POSITIVE INTERNET COMPANY computer network by whatever means may be deemed by POSITIVE INTERNET COMPANY (at POSITIVE INTERNET COMPANY's sole and absolute discretion) to be a profligate use of Service and/or the POSITIVE INTERNET COMPANY computer network.

  • If the hourly rate is not agreed then such work will not be undertaken by POSITIVE INTERNET COMPANY.

  • POSITIVE INTERNET COMPANY will ask the Customer for payment in advance for the connection charge and subscription for the Minimum Period of service for the Service requested, and this payment which is non` refundable must be received by POSITIVE INTERNET COMPANY before any Service is provided.

  • No variation to these terms and conditions shall be binding unless agreed in writing between the respective authorised representatives of POSITIVE INTERNET COMPANY and the Customer.

  • The Contract represents the entire agreement between the parties and supercedes all previous agreements, understandings or arrangements between POSITIVE INTERNET COMPANY and the Customer except in relation to any fraudulent misrepresentations.

  • POSITIVE INTERNET COMPANY hereby excludes all liability of any kind for the transmission or reception of data/information of whatever nature.

  • The Customer hereby expressly and explicitly agrees that it has complied with all of the provisions of the Data Protection Act 1998 and consents to POSITIVE INTERNET COMPANY putting the names and other information from the order form relating to the Customer or passed by the Customer to POSITIVE INTERNET COMPANY into a computerised directory for internal use, for passing to other companies for marketing purposes and for the use of any successors or assigns of the POSITIVE INTERNET COMPANY.
