PM&E Measures definition

PM&E Measures will mean those measures included by FERC in any New License to protect, mitigate and enhance those facilities or resources impacted by the existence and operation of the UARP.

Examples of PM&E Measures in a sentence

  • To the extent SMUD is ultimately successful in its challenge to the inclusion of the Flow-Related PM&E Measures in its New License or its challenges to the 401 Certification or the NPDES Permit, the Parties will modify the renegotiated terms accordingly.

  • The criteria set forth in Section 13.2 above will be applied to ensure that (a) the operational considerations specified in Section 13.2 are not materially impaired by deliveries to and storage for the El Dorado Parties; and (b) payments from the El Dorado Parties to SMUD are commensurate with the changes resulting from the Flow-Related PM&E Measures.

  • Certain PM&E Measures will be delayed until the New License has become final.

  • The Environmental Coordinator shall arrange an annual meeting of the RCC as well as any additional meetings deemed necessary by the Parties to coordinate activities and inform the Parties concerning the status or implementation of PM&E Measures.

  • If the New License does not contain all of the PM&E Measures because FERC expressly determines that it does not have jurisdiction to adopt or enforce the omitted PM&E Measures, the Parties agree, provided the measure is otherwise enforceable under this Agreement or applicable laws and no Party believes that the omission creates a material inconsistency, that they shall be bound by the entire Agreement, including those PM&E Measures omitted by FERC.

  • The Parties intend that implementation of the PM&E Measures contained in this Agreement and the Final Terms and Conditions will achieve and fully satisfy the management goals.

  • PacifiCorp shall designate an Environmental Coordinator to oversee the coordination and implementation of PM&E Measures.

  • The Governmental Parties reserve any remedies under applicable law to enforce the PM&E Measures contained in this Agreement.

  • The Cowlitz PUD Committee Coordinator(s) shall oversee the coordination and implementation of the terrestrial and aquatics PM&E Measures that are the responsibility of Cowlitz PUD as provided in this Agreement.

  • Where one or more Parties have approval authority under this Agreement, Licensees shall notify the Commission of any approvals that were not obtained, include the relevant comments of the Parties with approval authority, describe the impact of the lack of approval on the schedule for implementation of PM&E Measures, and describe proposed steps to be taken to gain the approval, including dispute resolution.
