Physically fit definition

Physically fit means, in the opinion of the medical doctor, able to carry out efficiently all the duties and responsibilities of the position without endangering self, the public, or fellow fire fighters because of physical condition. It is agreed that failure to pass a standard physical examination as used by Canadian insurance companies would be construed as failure to pass the medical examination in this section.
Physically fit shall include the employee's weight being reasonable. Such action shall only be taken if a physical examination performed by a medical doctor of the Employer's choice at the Employer's expense reveals such physical unfitness, and if the employee is not adhering to a regimen prescribed by the Employer's doctor to correct such unfitness. If the employee disagrees with such doctor's findings, then the employee, at his own expense, may obtain a physical examination from a medical doctor of his choice. Should there be a conflict in the findings of the two doctors, then a third medical doctor mutually satisfactory to the Employer and the Union shall give the employee a physical examination. The fee charged by the third doctor shall be shared equally by the Employer and the employee and his findings shall be binding on the employee, Employer and the Union. In the event such employee wishes to continue his health and life insurance and pension plan, he may do so at this own expense pursuant to the terms of said plan.

Such action shall only be taken if a physical or mental examination performed by a doctor of the Employer's choice, at the Employer's expense, reveals such physical or mental unfitness. Physical examinations will be performed by a medical doctor, while mental examinations will be performed by a Psychiatrist or Psychologist in accordance with IACP standards. If the employee disagrees with such findings, then the employee, at his own expense, may obtain a physical or mental examination from a doctor, Psychiatrist or Psychologist, as described above, of his choice. Should there be a conflict in the findings of the two examinations, then a third examination will be given by a doctor, psychiatrist or psychologist, as described above, mutually satisfactory to the Employer and the Association. The fee charged by the third doctor shall be paid by the Employer and his findings shall be binding on the employee, Employer and Association.
