Phonograph Records definition

Phonograph Records shall include any and all mechanical reproductions of the Masters produced and delivered hereunder, in any format, whether now known or unknown, including but not limited to compact discs, cassette tapes, vinyl records, DAT tapes or any future format.
Phonograph Records include Audio-Visual Recordings and Audio-Visual Records, respectively; and
Phonograph Records means any device now or hereafter known, on or by which sound may be recorded and reproduced, which is manufactured or distributed primarily for home and/or consumer and/or jukebox use and/or use on or in means of transportation, including Electronic Transmission, but excluding "sight and sound" devices.

  • G2 may cause one or more federal applications for trademark protection to be made in favor of Artist for Phonograph Records and/or entertainment purposes.

  • Artist agrees that G2 may cause a search to be instituted for the purpose of determining whether any professional name used by Artist has been or is being used by another person in connection with Phonograph Records.

  • All Controlled Compositions (defined as musical compositions composed in whole or in part by any individual member of Artist) are hereby licensed to G2 and its licenses for reproduction on Phonograph Records anywhere in the Universe.

  • Artist shall not use a different name in connection with Phonograph Records unless Artist and G2 mutually agree in writing.

  • However, nothing contained herein shall be construed as absolutely committing The Record Company to commercially release any Master Recordings made by The Artist as Phonograph Records during the term of this agreement.

  • Artist warrants and represents that it is the sole owner of such name in connections with Phonograph Records during the term hereof.

  • Further, The Record Company (or any third party Distributor selected by The Record Company), at its election and in its sole business judgment, may advance manufacturing, mastering, duplication, reproduction, packaging, promotional, marketing and advertising expenses in connection with such Master Recordings and resulting Phonograph Records.

  • During the term of this agreement, The Record Company hereby engages the exclusive personal services of The Artist as a performing artist for the purpose of making Master Sound Recordings for distribution in any medium now known or hereafter devised, including but not limited to phonograph records, LP's, singles, compact discs, and cassettes (hereinafter referred to as "Phonograph Records").

  • All Controlled Compositions (defined as musical compositions composed in whole or in part by any individual member of Artist) are hereby licensed to Parallax and its licensees for reproduction on Phonograph Records anywhere in the Universe.

Phonograph Records. Recordings", and "Derivatives" mean and include Compact Disc, Cassettes, Long-Play Records and any and all forms of recordings and reproductions, NOW KNOWN OR WHICH MAY HEREAFTER BECOME KNOWN, manufactured or sold primarily for home and/or juke box use and/or use on or in means of transportation, INCLUDING WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, magnetic recording tape, film, electronic video recordings and any other medium or device for the reproduction of artistic performances manufactured or sold or use on or in means of transportation, whether embodying sound alone or sound synchronized with visual images, e.g. "sight and sound" devices.

  • Client Records has the meaning set forth in Section 3.14.

You may not publish or use any sales literature or promotional materials with respect to the Funds without our prior review and written approval.
