The following guidelines will be used for the Home Language Survey in order to identify Primary Home Language Other Than English (PHLOTE) students.
Specifically, the committee will identify all exempted PHLOTE students who are not successfully participating in the District’s program, as determined by student grades in academic core subjects (or comparable measure).
Establish procedures to ensure that the parents and guardians of PHLOTE students are notified adequately and timely of special education-related matters that are called to the attention of other parents in the language and form of communication understood by them.
As of the date of execution of this Agreement, the District agrees that any PHLOTE student, based on responses provided via the home language survey, will be promptly assessed for English language proficiency in the four language domains (listening, speaking, reading, and writing) using existing language proficiency assessments to determine eligibility for placement in an English language development program.

The LFCISD will provide all staff instructions on the use of the HLS and direct staff to use the HLS at each campus to identify PHLOTE students.
The LFCISD will determine objectively whether PHLOTE students can speak, read, write, and comprehend English, and if all four language skills are expected of their grade-level peers.
By December 21, 2018, the District will submit to OCR supporting documentation indicating that each new fall semester 2018-2019 PHLOTE students have been assessed or reassessed.
