Phase I Work definition

Phase I Work shall have the meaning specified in Exhibit A to this Agreement. “Phase II Work” shall have the meaning specified in Exhibit A to this Agreement.

Phase I Work means the County’s design and engineering work, land use entitlements and other governmental approvals required for the Project, its acquisition of the Jefferson Station Parcel, and, if applicable, its acquisition of the Veritable Quandary Property, all as set forth in Exhibit A.

• The Parties acknowledge that the EAA is expected to impose and begin collecting Program Aquifer Management Fees prior to the submittal by the Implementing Committee to the EAA of the proposed Annual Program Budget for 2013 for EAA Board approval in order to ensure that sufficient funding will be available on January 1, 2013, to pay Program Expenditures during the initial year of the Comprehensive Phase I Work Plan.

• Costs incurred under this Subsection are subject to approval pursuant to the provisions in this Agreement governing the Comprehensive Phase I Work Plan, the Comprehensive Phase II Work Plan, Annual Party Work Plans and Cost Estimates, and Annual Program Budgets.

• Not later than March 1, 2012, the Implementing Committee will develop and approve a Comprehensive Phase I Work Plan, which will include descriptions, schedules, and cost estimates for the Phase I Conservation Measures and all Program activities to be conducted or managed by the Parties and the Program Manager that are to be funded from the HCP Program Account for the Phase I period through December 31, 2019.

More Definitions of Phase I Work

Phase I Work means all activities necessary to implement the removal of sediments from the Phase I Area identified in Appendix B and the transport and off-site disposal of those materials pursuant to an Action Memorandum to be issued by EPA, Region 2, based on the Phase I EE/CA.

Phase I Work means that portion of the Work comprising all Public Improvements and at least 34,00 s.f. of commercial space as described in Section 3.5.1 hereof.

Phase I Work. Substantially Complete (as defined in the Tenant Work Letter). For the avoidance of doubt, Direct Expenses shall be due and payable during the Beneficial Occupancy Period. Landlord and Tenant shall enter into a Notice of Lease Term Dates on the form set forth in Exhibit C of the Lease on or prior to the Beneficial Occupancy Start Date (as defined below).

Phase I Work means all improvements to be constructed in the New Premises in accordance with and as indicated on the Phase I Working Drawings. Landlord’s approval of the Phase I Working Drawings shall not be a representation or warranty of Landlord that such drawings are adequate for any use or comply with any law, but shall merely be the consent of Landlord thereto. Tenant shall, at Landlord’s request, sign the Phase I Working Drawings to evidence its review and approval thereof. After the Phase I Working Drawings have been approved, Landlord shall cause the Phase I Work to be performed in accordance with the Phase I Working Drawings. Landlord shall cause the Contractor to construct the Phase I Work to comply with the Phase I Working Drawings and Legal Requirements.

Phase I Work are used in such Agreement of Surety Indemnity, the same shall hereafter mean "Phase IA and Phase IB Work". Executed as of the date first written above.
