Personal Possession definition

Personal Possession means actual physical custody of or the ability to exercise control over or have access to. This is limited to possession for the sole purpose of one’s own personal use. This does not include possession with intent to deliver, distribute, transfer, or sell.
Personal Possession means upon the person.

In attempting to determine whether or not an object is intended, designed or adapted for use of consuming a controlled substance, a person, court, or any other authority should consider, in addition to all other logically relevant factors, the following enumeration of devices or instrumentalities of which are commonly involved with the consuming of controlled substances:(a) Kits or items used, intended or designed for use in planting, propagating, cultivating, growing or harvesting of any species of plants which is a controlled substance or from which a controlled substance can be derived.(b) Kits or items used, intended or designed for use in manufacturing, compounding, converting, producing, processing or preparingcontrolled substances or controlled substance analogs.(c) Devices used, intended or designed for use in increasing the potency of any species of plant which is a controlled substance.(d) Testing equipment used, intended or designed for use in identifying or analyzing the strength, effectiveness or purity of controlled substances or controlled substance analogs.
