At your request, we will promptly provide you with such reasonable assistance as necessary to enable you to notify relevant Personal Data Breaches to competent authorities and/or affected Data Subjects, if you are required to do so under Data Protection Laws.
We will implement and maintain appropriate technical and organizational measures to protect Personal Data from Personal Data Breaches, as described under Annex 2 to this DPA ("Security Measures").
At the Controller’s request, Processor will promptly provide the Controller with all reasonable assistance necessary to enable the Controller to notify relevant Personal Data Breaches to competent authorities and/or affected Data Subjects, if Controller is required to do so under the Data Protection Law.
Processor shall adhere to procedures aimed at discovering, responding to and resolving Personal Data Breaches.
Taking into account the nature of the Processing and the information available, the Contractor must assist the Framework Authority in complying with the Framework Authority’s obligations concerning the security of Personal Data, reporting requirements for Personal Data Breaches, data protection impact assessments and prior consultations in accordance with Articles 32 to 36 of the GDPR.
For the avoidance of doubt, Personal Data Breaches will not include unsuccessful attempts to, or activities that do not, compromise the security of Personal Data including, without limitation, unsuccessful log in attempts, denial of service attacks and other attacks on firewalls or networked systems.
The Processor shall document (and shall keep such documentation available for the Controller) any Personal Data Breaches, including the facts related to the Personal Data Breach, its effects and the corrective measures taken.
After consulting with the Controller, the Processor shall take any measures needed to limit the (possible) adverse effects of Personal Data Breaches (unless such consultation cannot be awaited due to the nature of the Personal Data Breach).
The obligation to remediate the cause of a Personal Data Breach shall not apply to Personal Data Breaches that are caused by Customer or Customer’s Users.
The Sponsor agrees to take reasonable steps to proactively prevent Personal Data Breaches, and / or equivalent breaches relating to Pseudonymised Data of Participants, and to respond appropriately to incidents or near misses.
