Permitted Use Terms means the terms applicable to a Permitted Use as specified in Schedule 2 (Permitted Use Terms) and Schedule 3 (Price List);

  • Subject to clauses 8.1 and 8.3, the LME's entire liability howsoever arising as a result of the indemnity under clause 9.1 shall be limited in respect of all incidents or series of incidents arising out of the same circumstances or claim, to the lower of (i) 100% of the Fees paid by the Licensee during the 12 month period immediately preceding the event giving rise to the liability and (ii) USD 50,000, unless otherwise stated in the Permitted Use Terms.
