All Permitted Access shall be subject to the requirements set forth in this Section 23 and the applicable Service Schedule.

The obligation of Beneficiary hereunder shall terminate upon the earliest of (1) foreclosure of the lien of this All-Inclusive Deed of Trust, or (2) cancellation of the note secured hereby and reconveyance of this All-Inclusive Deed of Trust.
For the avoidance of doubt, this Amendment does not change any requirement under Section 4.1.1 of the Agreement that requires agreement of the Parties to make an adjustment in the Cap for a Permitted Access Program before more than [***] attributable to Permitted Access Programs can be deducted from gross sales to calculate Net Sales.
Notwithstanding the foregoing, however, upon the expiration or earlier termination of this Sublease or Subtenant’s right to possession of the Subleased Premises, Tenant shall have the right to require Subtenant to remove from the Permitted Access Areas such of Subtenant’s equipment as Tenant may designate at Subtenant’s sole cost and expense.
