PERMIT DENIAL definition

PERMIT DENIAL means the document issued by the Conservation Commission pursuant to the Bylaw which disallows proposed work.

PERMIT DENIAL means a writtenCorps denial with prejudice (see 33 CFR 320.4(j)) of an individual standardpermit as defined in 33 CFR 325.5(b). Permit denials also include cases where a proffered individual permit is refused by the applicant in writing because the applicant objects to the terms or special conditions of the proffered permit and the permit is subsequently denied withprejudice by the District Engineer. If the applicant refuses a proffered generalpermit, the District Engineer will notdeny a permit for the proposed project based on that refusal. The applicantmust apply for an individual permit. If that individual permit is subsequently denied with prejudice, then theapplicant may request an appeal of that denial.
