Permanently working means working for any period in excess of four consecutive weeks. 31.3 Provided that in the case of an employee who changes from working on one shift to working on another shift the time of commencement of which differs by four hours or more from that of the first ("change of shift") he or she shall be paid an amount equal to 4 per cent of the relevant allowance rate on the occasion of each such change in addition to any amount payable under the preceding provisions of this clause ("change of shift allowance"). 31.4 Notwithstanding the provisions of 31.3 above the change of shift allowance is not payable in the following circumstances: 31.4.1 Where the employer agrees to a request in writing made on behalf of one or more employees for changes in shifts; 31.4.2 Where there is an intervening period of more than 48 hours off duty, inclusive of all leave, weekends, accrued days off, rostered days off and public holidays; (a) In the case of an employee under the Nurses Award as incorporated, such employee at the time of engagement has agreed in writing on the same hours worked each day, on the same days of the week, and the same starting and finishing hours as those of the roster which require a change of shift. Permanently working means an employee shall be deemed to be and to have been."permanently working" an afternoon or night shift or combination of afternoon and night shifts if:
Permanently working means an Employee who: 8.7.1 works on an afternoon or night shift or combination of such shifts without rotating or alternating with another shift or with day work so as to give the Employee at least one third of working time off that afternoon or night shift or combination of such shifts in each shift cycle; or 8.7.2 remains on an afternoon or night shift only, or a combination of afternoon and night shifts, for a longer period than four consecutive weeks; or 8.7.3 is specifically engaged to work on an afternoon or night shift only, or on a combination of afternoon and night shifts only.
